Summary of the Problem: A bank client wanted to send a huge amount of money via bank transfer to his daughter’s account, the client gave the correct account number to the bank’s employee , but while the bank’s employee was busy chatting with another bank’s employee , he made an error by registering an account number of another person unknown to the client, the bank made the bank transfer to the wrong account and the accountholder to whom the amount has been wrongly transferred withdrew the amount. The client and his daughter discovered the occurrence of the wrong transfer and started to yell. It is proved that the wrong bank transfer has been caused by the bank and that the bank is fully liable for correcting the error and returning the amount to the client’s account, accordingly, the bank shall take the following corrective banking and legal procedures:
Firstly: The bank shall return the full amount to the client’s account from the bank’s account and apologize to the client for the error caused by the bank
Secondly: The bank shall contact the accountholder to whose account the amount has been wrongly transferred or meet him\her and request him\her to return the amount to the bank within three days (for example) and this shall be proved by recorded call or witnesses or through legal notice prepared by a lawyer or financial consultant, if the said person returned the money to the bank, the bank’s problem will be solved amicably.
Thirdly: If the three-day period passed without returning the money to the bank or the accountholder to whose account the amount has been wrongly transferred refused to return the amount to the bank, the bank shall file a criminal possession case against him\her and the bank’s criminal case will be a 100% win-win case, and thereby the bank’s problem will be legally solved. Under all circumstances, the client’s problem and the bank’s problem will be solved at end of the day and their spokesman will say: one laughter in the air is better than any medicine or healthcare.
