Summary of the Merits of the Case
On 9, August, 2022, and in Zagazig city, a student called Islam Mohammad, killed student Salma Bahgat, by stabbing her 17 times on the main street and in front of many witnesses because she rejected his marriage proposal, the Egyptian Public Prosecutor referred the case to Zagazig criminal court.
Summary of the Procedures and Judgment
On 3\10\2022, Zagazig criminal court accepted the medical report, which confirms that the accused was of sound mind at the time of committing the murder crime and inferred that the accused’s full criminal liability has been proved without any reasonable doubt. Accordingly, Zagazig criminal court convicted the accused , issued a preliminary death sentence against him and referred the death sentence to the grand mufti for his opinion. Zagazig criminal court set a session on 3\11\2022 for issuing the final verdict.
Summary of the Legal Opinion
Legal warning: crime is useless, in most cases, criminals are arrested, tried, convicted and penalized. In this particular case, we notice that the four legal elements of the crime of premeditated murder, which are criminal intent, criminal act, causation and non-availability of any legal defense on the accused’s side, have been proved beyond any reasonable doubt, therefore, the expected final verdict on 3\11\2022 will definitely be the death sentence and it will be enforced thereafter taking into consideration that the grand mufti’s opinion is non-binding on the court and obtaining it is deemed a mere formality.
