Summary of the Problem: Let us assume you are a bank client, you have a current account with the bank, the bank granted you a personal loan, you are used to repaying the loan installments on the due dates without delay, that is to say, you are very lucky indeed because you enjoy your annual vacation in Maldives Islands , in short , everything is fine for you as you have no financial problems whatsoever with the bank.

Suddenly, the bank blocked your account , you received a summons to court a few days after returning to your country and before the expiry of your annual leave and later on you discovered that the bank has filed a civil case against you and that a travel ban has been imposed on you to the extent that it prevents you from traveling outside the country.

You were quite surprised at that unexpected procedure as seemingly there is no clear reason for filing the case against you , then, you tried to guess the cause of action of the civil case filed against you by the bank but in vain, so you contacted your bank in trying to find an answer , you contacted the Bank’s Finance Department, they confirmed your punctual repayment of the instalments , the hill of suspiciousness turned into a mountain , you personally visited the bank’s Legal Department and there the legal manager informed you that the cause of action for filing the civil case by the bank against you is the termination of your employment contract by the employer who sent a copy of your termination letter to the bank for its information\record.

Summary of the Solution: according to the bank’s standard general terms and conditions, the bank shall have the legal right to file a civil case against any client and request the court to issue and impose a travel ban on the client whose employment contract has been terminated, even if the client  repays the loan instalment without any delay , Why?! because the client’s salary is the only security available to the bank which secures the repayment of instalments of the personal loan in the future, so, there is no security without salary !! accordingly, the bank has just exercised its legal right by filing a civil case against you. The only solution available to you is to find another employer, sign a new employment contract, obtain a salary letter from your new employer and provide the bank with copy thereof in order for the bank to dismiss the case and lift the travel ban imposed against you. When you apply this solution, when the bank dismisses the case and lifts the travel ban, then, you can forget your annoyance and give a loud laugh and say to the entire world: one laugh in the air is better than any medicine or healthcare!!Advocate\Faisal Ali Addabi
