Summary of the problem
Racial discrimination means treating a person less favorably, or not giving the person the same opportunities or rights, as others in the same society, on the basis of their race, the country where they were born, their ethnic origin or their skin color.
Example of negative racial discrimination: A racist employer refused to appoint a suitably qualified black person as a shop assistant and instead appointed a less qualified white person because they thought they could lose customers if they had a black person working in the shop.
Summary of the Solution
Firstly: In accordance with the public international law, racial discrimination against any person is not legally unacceptable at all and the proof can be presented as follows:
The Universal Declaration of Human Rights contains three important articles which can be presented as follows:
Article 1
All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.
Article 2
Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.
Article 23
1-Everyone has the right to work, to free choice of employment, to just and favorable conditions of work and to protection against unemployment.
2- Everyone, without any discrimination, has the right to equal pay for equal work
Secondly: most countries in the world have ratified and signed the Universal Declaration of Human Rights, therefore, the local laws of each country must contain articles which confirm the right of equal treatment and non-discrimination between persons in the workplace on the ground of race or clour, if the local laws of the said country do not contain such a right and if there is racial discrimination against persons, that will be deemed a serious breach of the public international law and it will cause irreparable damage to the country’s reputation , condemnations from the United Nations, international and local human rights organizations and countries that support human rights will be issued against the breaching country and the said country may be subject to painful international blockades and penalties .
The local laws of all countries must protect people against racial discrimination in all areas of public life including, without limitation, employment; education; getting or using services; renting or buying houses or residential units; and accessing public places, also the local laws shall criminalize racial discrimination and racial hatred.
In addition, the local laws and policies of each country shall allow for special measures of positive discrimination that aims to foster greater racial equality by supporting groups of people who face, or have faced, racial discrimination so they can have the same opportunities and rights as others in the same society. Example of positive racial discrimination: Rental assistance can be given to black poor students is deemed a special measure of positive racial discrimination.
Thirdly: If the aggrieved person finds an article in their country’s local law which confirms the person’s right for equal treatment, and this is quite probable, then that person or their lawyer can file a tort case before the civil court and claim canceling the employer’s racist decision in addition to claiming compensation for any damages which directly resulted from that racism. I confirm that any such case will be a 100% win-win case and the aggrieved person will obtain equal treatment at work at the end of the day together with fair compensation and then, the said person can smile, laugh and say to the entire world: a person who laughs last laughs best!!
